These Terms of Use ("Terms") govern your access to and use of the websites, mobile applications, resident and prospect portals, online applications, text messaging and chat services, and related online services operated by Lumen Capital LLC ("we," "us," or "our") (collectively, the "Site").
These Terms apply to our corporate website at www.lumencp.com and to each of the apartment community websites we operate, including but not limited to www.brazosapts.net and www.aspenamarillo.com, together with any other website, landing page, or online service of ours that links to these Terms.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Site.

You must be at least 18 years of age to use the Site, submit a lease application, or enter into a lease. By using the Site, you represent that you are at least 18 and that you have the legal capacity to enter into these Terms.

We are committed to the letter and spirit of the Fair Housing Act and all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected by applicable law in the sale, rental, financing, or advertising of housing.

Information on the Site regarding floor plans, square footage, rental rates, fees, deposits, specials, amenities, and unit availability is provided for general informational purposes only and is subject to change at any time without notice. Rental rates and availability are not guaranteed until a lease is executed. Floor plans, photographs, virtual tours, and renderings are representative and may not depict the specific home offered. Square footage figures are approximate.
Nothing on the Site constitutes an offer, a reservation, or a guarantee of a particular home, rate, or term. In the event of a conflict between information on the Site and a fully executed lease, the lease controls.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:

Use the Site in any way that violates any applicable federal, state, local, or international law or regulation, including fair housing laws.
Submit false, inaccurate, or misleading information, including on any lease application, or impersonate any person or entity.
Use any robot, spider, scraper, or other automated means to access the Site or collect information from it, or otherwise attempt to harvest data from the Site.
Attempt to gain unauthorized access to any portion of the Site, any account, or any system or network connected to the Site.
Introduce any virus, malware, or other material that is malicious or technologically harmful.
Interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure.
Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site for any commercial purpose without our express written consent.

Certain features of the Site, including the resident portal, prospect portal, and online lease application, require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Application fees, administrative fees, and deposits submitted through the Site are governed by the terms disclosed at the time of payment and by applicable law. Application fees are generally non-refundable. Submission of an application does not guarantee approval or the availability of any particular home.

Consent to receive messages and calls. By providing your phone number to us through the Site, a contact form, an application, or otherwise, you agree to receive transactional and, where you have separately opted in, promotional text messages and telephone calls from Lumen Capital LLC or our service providers about our properties at the number you provided, including through automated means such as an automatic telephone dialing system or a prerecorded or artificial voice.

Consent is not a condition. Consent to receive text messages or calls is not a condition of purchasing any property, goods, or services, or of entering into a lease. You may apply for and lease a home without providing consent to marketing messages.

Opt-OutYou may opt out of promotional text messages at any time by replying STOP to any message. Opting out of promotional messages will not affect transactional messages relating to your application, lease, or maintenance requests. Message frequency. Message frequency varies.

Rates. Message and data rates may apply depending on your mobile phone service plan.

Mobile opt-in data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent, and this information will not be shared with third parties.

AI-assisted communications.
Our leasing and maintenance communications across text, chat, telephone, and email are operated in part by an automated artificial intelligence agent provided by Entrata, Inc. on our behalf. When you communicate with us through these channels, you may be interacting with an automated system rather than a person. These communications, including telephone calls, may be recorded, transcribed, and retained. Responses generated by an automated system are provided for convenience and general information, may contain errors, and do not constitute a binding offer or commitment by us. You may request to speak with a member of our onsite team at any time

By using the Site, you consent to receive communications from us electronically, including by email, text message, and postings on the Site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Where you execute a lease, application, or other document electronically, you agree that your electronic signature is the legal equivalent of your manual signature under the federal E-SIGN Act and applicable state law.

The Site and its contents, including text, graphics, logos, images, photographs, floor plans, virtual tours, software, and the selection and arrangement thereof, are owned by Lumen Capital LLC or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. The Lumen Capital LLC name, our community names, and our logos are our trademarks. You may not use them without our prior written permission.

You may view, download, and print pages from the Site for your personal, non-commercial use in connection with evaluating or maintaining a tenancy with us. All other use is prohibited without our express written consent.

If you submit reviews, comments, photographs, maintenance descriptions, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content in connection with operating and promoting our communities. You represent that you own or have the necessary rights to the content you submit and that it does not violate the rights of any third party or any applicable law.

We reserve the right, but assume no obligation, to remove any user-submitted content at our discretion.

The Site may contain links to third-party websites, applications, or services, including payment processors, screening providers, insurance providers, and mapping services. These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or availability of any third-party site or service. Your use of any third-party site or service is governed by that party's own terms and privacy policy.

We are committed to making the Site accessible to individuals with disabilities. THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUMEN CAPITAL LLC, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING ANY OBLIGATION ARISING UNDER A LEASE OR UNDER APPLICABLE LANDLORD-TENANT OR FAIR HOUSING LAW.

You agree to indemnify, defend, and hold harmless Lumen Capital LLC, its affiliates, and their respective officers, members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

This section does not apply to disputes arising under a lease, which are governed by the terms of that lease and applicable Texas landlord-tenant law.

We may revise these Terms at any time. When we do, we will post the revised Terms on the Site and update the "Last Updated" date above. Your continued use of the Site after the revised Terms are posted constitutes your acceptance of them. We encourage you to review these Terms periodically.

We may suspend or terminate your access to all or part of the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. The provisions of these Terms that by their nature should survive termination will survive, including the sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site, and supersede any prior agreements regarding that subject matter. They do not supersede or modify any lease agreement between you and us.
